Trading operations with ATAIX Eurasia Ltd. and use of our Services are at your own risk. The risk of loss when trading or owning crypto assets can be significant. Cryptocurrency price volatility is beyond the control of ATAIX Eurasia Ltd. Any profit or loss resulting from fluctuations in the value of the relevant cryptocurrency will be entirely at Your expense and risk. ATAIX Eurasia Ltd. is not responsible for any losses incurred by You as a result of your own decisions to buy or sell in relation to crypto-assets of any type.

Users acknowledge the following risks associated with the User's use of the Company's Website and Services:

  • The risk of loss when trading digital assets, electronic money, virtual or digital currencies or tokens such as bitcoin or other digital assets can be significant and losses can occur within a short period.
  • The price and liquidity of Digital Assets have been subject to significant fluctuations in the past and may be subject to significant volatility in the future.
  • Digital assets and other electronic money, virtual or digital currencies are not legal tender, are not backed by any government, and accounts and fund balances are not covered or protected by any insurance scheme or investor protection system.
  • Legislative and regulatory changes or actions at the national, regional, or international level may adversely affect the use, transfer, exchange, and value of Digital Assets and other electronic money, virtual or digital currencies.
  • Transactions with Digital Assets and other electronic money, virtual or digital currencies may be irreversible and, accordingly, Losses due to fraudulent or accidental transactions are not refundable.
  • Some transactions with Digital Assets and other electronic money, virtual or digital currencies are considered completed on the date the transaction is registered in the public register, even if it is different from the date or time when the Users initiate the transactions.
  • The value of Digital Assets and other electronic money, virtual or digital currencies depends on the constant willingness of market participants to exchange Fiat Currency for Digital Assets or other electronic money, virtual or digital currencies, which may lead to possible permanent and complete losses in the value of certain Digital Assets and other electronic money, virtual or digital currencies in the event of the disappearance of the market for these Digital Assets and other electronic money, virtual or digital currencies.
  • There is no guarantee that a person who accepts Digital Assets and other electronic money, virtual or digital currency as payment today will continue to do so in the future.
  • The origin of Digital Assets and other electronic money, virtual or digital currencies may lead to an increased risk of fraud, cyber-hacks or attacks, and may also mean that technological difficulties faced by the Company may prevent the access or use of Users Digital Assets and other electronic money, virtual or digital currencies.
  • Any User Company Account and Wallet held on your behalf may not be sufficient to cover all losses suffered by Users.

Using the website of ATAIX Eurasia Ltd. and by entering into these Terms of Use, the User fully understands and has been aware of the inherent and potential risks associated with investing in any products or services provided by ATAIX Eurasia Ltd., including, but not limited to, the risk of the complete loss of funds and investments of the User or delay in payment or the realization of profits related to the provision of a service by ATAIX Eurasia Ltd. operating in a regulatory test system (“FinTech Lab”).

I fully acknowledge the potential risks associated therewith, whether contemplated or otherwise, AND HEREBY EXPRESSLY AND UNCONDITIONALLY RELEASE FROM LIABILITY AND EXECUTION OF OBLIGATIONS, WAIVE CLAIMS AND UNDERTAKE NOT TO SUE AND AGREE TO INDEMNIFY THE ASTANA FINANCIAL SERVICES REGULATORY COMMITTEE AND ITS OFFICIALS, as well as the respective successors of all of the foregoing, in respect of any claims, liabilities, legal actions in connection with damages, losses, expenses, directly or indirectly arising out of or otherwise connected in any way with the activities, services or products provided by ATAIX Eurasia Ltd.

The user may sue ATAIX Eurasia Ltd. for all claims, liabilities, legal actions for damages, losses, and expenses arising out of or otherwise related in any way to the activities, services, or products provided by ATAIX Eurasia Ltd.

On regulation

ATAIX Eurasia Ltd. is authorized by the financial regulator of the AIFC, the Astana Financial Services Authority (“AFSA”), to operate the Electronic Asset Trading Platform in the FinTech Lab* test environment (AIFC experimental legal regime) under license No.AFSA-G-LA-2022-0002, which term expires on April 06, 2024. License status and validity period can be checked on the AFSA website (www.afsa.kz).

* FinTech Lab is a regulatory sandbox (experimental legal regime) that allows firms to provide financial services in a test environment with individual regulatory requirements set by the AFSA and subject to specific licensing conditions, including limits on transaction size and the number of users. The FinTech Lab was established by AFSA within the AIFC to assist AFSA in developing innovation in the financial industry. Upon completion of the FinTech Lab testing, this firm is expected to continue to provide services in accordance with applicable AIFC rules, however, it is also possible that this firm may not continue to provide services in or out of the AIFC.

Given that the firm offers services to Users in a regulatory test environment, and that risk is inherent in innovation, there is a potential for loss of investment and other losses associated with the use of the service.

Complaint Procedure

Customers and individuals who are dissatisfied with the services or products offered by ATAIX Eurasia Ltd. or its employees may file a complaint with the Astana Financial Services Authority (“AFSA”), the financial regulator of the Astana International Financial Centre.
